Terms of sale

The following terms of sale are concluded on the one hand by the company Awena Studio, whose registered office is located at 28 Avenue Auber - 06000 Nice, registered with the Nice Trade and Companies Register under number 984 380 758 hereinafter referred to as "Awena Studio" and managing the website https://awenastudio.com, and on the other hand, by any natural or legal person wishing to make a purchase via the website https://awenastudio.com hereinafter referred to as "the buyer".

Article 1. Object

These terms of sale aim to define the contractual relationships between Awena Studio and the buyer and the conditions applicable to any purchase made through the website https://awenastudio.com. The acquisition of a product through this site implies an unconditional acceptance by the buyer of these terms of sale, of which the buyer acknowledges having prior knowledge before placing an order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://awenastudio.com is not directly related to his professional activity and is limited to strictly personal use, and on the other hand, that he has full legal capacity, allowing him to commit under these general conditions of sale. Awena Studio reserves the right to modify these sales conditions at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those appearing on the website https://awenastudio.com of the company Awena Studio, within the limits of available stocks. Awena Studio reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description outlining its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but do not engage the Seller in any way. The sale of products presented on the website https://awenastudio.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices appearing on the product sheets of the internet catalog are prices in Euros (€) all taxes included (VAT) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Awena Studio reserves the right to modify its prices at any time, however, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased depending on the delivery address of the order.

Article 4. Ordering and Payment Terms

Before placing any order, the buyer must create an account on the website https://awenastudio.com. However, the buyer can also place an order as a guest. The account creation section is accessible directly from the side menu bar. Upon each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. Awena Studio offers the buyer to order and pay for his products in several steps, with several payment options to choose from:

• Payment by bank transfer: the buyer selects the products he wishes to order in the "cart", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses his preferred payment method. Finally, the last step offers him to check all the information, to become aware of and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the "Confirm my order" button. This last click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation confirming the registration of his order. In order to finalize his payment and trigger the processing of his order, the buyer must contact his bank to make the transfer corresponding to the amount of his order to the bank account of Awena Studio, whose details are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be notified by email. Awena Studio will ship the products no later than 2 working days after receiving the transfer corresponding to the order, subject to availability.

The confirmation of an order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and renunciation to avail oneself of one's own conditions of purchase. All the data provided and the confirmation recorded will constitute proof of the transaction. If the buyer has an email address and has provided it on his order form, Awena Studio will communicate to him by email the confirmation of the registration of his order.

Article 5. Retention of Title

Awena Studio retains full ownership of the products sold until full payment of the price, in principal, fees, and taxes included.

Article 6. Right of Withdrawal

Under article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are processed by La Poste via COLISSIMO or another delivery partner with tracking, delivery without signature. Delivery times are given for information only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. Awena Studio may provide the buyer with the tracking number of his package by email. The buyer is delivered to his home by his postman. In case of absence of the buyer, he will receive a notice of passage from his postman, which allows him to collect the ordered products at the nearest Post Office, within a period indicated by the postal services. The risks related to transport are borne by the buyer from the moment the articles leave the premises of Awena Studio. The buyer is required to check, in the presence of the representative of the transport partner or the delivery person, the condition of the packaging of the goods and its content upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Awena Studio benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it can be returned to Awena Studio which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address: Awena Studio - 28 Avenue Auber - 06000 Nice, within thirty days after delivery.

Article 9. Liability

Awena Studio, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be held
