Terms of sale

These terms of sale are entered into, on the one hand, by the company Awena Studio, whose registered office is located at 28 Avenue Auber - 06000 Nice, France, registered with the Nice Trade and Companies Register (RCS) under number 984 380 758, hereinafter referred to as "Awena Studio", which operates the website https://awenastudio.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website https://awenastudio.com hereinafter referred to as "the buyer".

Article 1. Purpose

These terms of sale define the contractual relationship between Awena Studio and the buyer, as well as the conditions applicable to any purchase made through the website https://awenastudio.com. Purchasing a product through this website implies the buyer’s unreserved acceptance of these terms of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website https://awenastudio.com is not directly related to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity to enter into commitments under these general terms and conditions of sale.

Awena Studio reserves the right to modify these terms of sale at any time in order to comply with any new regulations or to improve the use of its website. Accordingly, the applicable terms will be those in force on the date the buyer places their order.

Article 2. Products

The products offered are those listed on the website https://awenastudio.com of Awena Studio, while stocks last. Awena Studio reserves the right to change its product range at any time. Each product is presented on the website with a description setting out its main technical characteristics (capacity, use, composition…). The photographs are as accurate as possible but are in no way binding on the Seller. The sale of the products presented on the website https://awenastudio.com is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the online catalogue are in euros (€), all taxes included (incl. VAT), taking into account the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Awena Studio reserves the right to change its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order will be the only price applicable to the buyer. The prices shown do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the delivery address of the order.

Article 4. Ordering and payment terms

Before placing an order, the buyer must create an account on the website https://awenastudio.com. However, the buyer may also place an order as a guest. The account creation section can be accessed directly from the side menu bar. On each visit, if the buyer wishes to place an order or view their account (order status, profile…), they must log in using these details. Awena Studio allows the buyer to order and pay for their products in several steps, with a choice of several payment options:

- Payment by bank transfer: the buyer selects the products they wish to order in the “cart”, makes any changes if needed (quantities, items…), and checks the delivery address or enters a new one. The shipping costs are then calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method. Finally, the last step invites them to check all the information, read and accept these general terms and conditions of sale by ticking the corresponding box, and then confirm their order by clicking the “Confirm my order” button. This final click constitutes the definitive conclusion of the contract. Once the order is confirmed, the buyer receives an order form confirming that their order has been registered. In order to finalise payment and trigger the processing of their order, the buyer must contact their bank to make a transfer for the amount of their order to Awena Studio’s bank account, the details of which are provided to the buyer. As soon as the transfer is received, the order will be processed and the buyer will be notified by email. Awena Studio will ship the products at the earliest 2 business days after receiving the transfer corresponding to the order, subject to stock availability.

Confirming an order entails acceptance of these terms of sale, acknowledgement of full knowledge of them, and waiver of the right to rely on the buyer’s own terms of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has entered it on their order form, Awena Studio will send them email confirmation that their order has been registered.

Article 5. Retention of title

Awena Studio retains full ownership of the products sold until full payment of the price has been received, including principal, charges and taxes.

Article 6. Right of withdrawal

Pursuant to Article L121-20 of the French Consumer Code, the buyer has fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for an exchange or refund without penalty, with the exception of return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. Orders are shipped by La Poste via COLISSIMO or another tracked delivery partner, delivered without signature. Delivery times are given for guidance only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer refunded. Awena Studio may send the buyer the tracking number of their parcel by email. The buyer’s order is delivered to their home by their postal carrier. If the buyer is not at home, they will receive a delivery notice from the postal carrier, allowing them to collect the ordered products from the nearest post office within the period specified by the postal service. Transport risks are borne by the buyer from the moment the items leave the premises of Awena Studio. The buyer is required to check the condition of the packaging and its contents upon delivery, in the presence of the transport partner’s agent or the delivery person. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Awena Studio are covered by the legal warranty provided for in Articles 1641 et seq. of the French Civil Code. If a product sold does not conform, it may be returned to Awena Studio, which will take it back, exchange it or refund it. All claims and requests for exchange or refund must be sent by post to the following address: Awena Studio - 28 Avenue Auber - 06000 Nice, within thirty days of delivery.

Article 9. Liability

Awena Studio, in the distance selling process, is bound only by an obligation of means (best efforts). It cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruption or other unintentional problems.

Article 10. Intellectual property

All elements of the website https://awenastudio.com are and remain the exclusive intellectual property of Awena Studio. No one is authorised to reproduce, exploit or use, for any purpose whatsoever, even partially, any elements of the website, whether in the form of photos, logos, visuals or text.

Article 11. Personal data

Awena Studio undertakes to keep confidential the information provided by the buyer that they may need to submit in order to use certain services. All information concerning the buyer is subject to the provisions of French Law No. 78-17 of 6 January 1978. Accordingly, users have the right to access, modify and delete their personal information. Article 12. Dispute resolution

These distance selling terms are governed by French law. For any dispute or litigation, the competent court shall be that of Nice.
